SaySomethingin (SSi) Terms and Conditions

These SSi Terms & Conditions (collectively, these “Terms”), are between you and SaySomethingin.com Cyf and they govern your and our respective rights and obligations. They constitute the agreement between you and us related to your SSi membership.
1. The Service
SSi is a membership programme offering multiple benefits and services to its members as set out in these Terms (collectively “SSi Service”).
SSi collects the SSi membership fee and is the seller of on-line language learning materials.
If you sign up for an SSi membership directly through us, you expressly request that we start providing you the SSi Service within your one month cancellation period. You also undertake to provide a valid email address as part of your registration so that we can contact you if we need to.
2. Membership
2.1. Membership fees, models and duration
The current membership fees, the available membership models and duration of the SSi Service are stated on our website. If you sign up for your SSi membership with us, you will find details about the membership model you are subscribed to, the applicable membership fee and the next due date on your account page.
The SSi membership fee is non-refundable except as expressly set forth in these Terms.
2.2. Payment
If you sign up for your SSi membership through us, are billed by us and you do not notify us before the next due date of your membership fee that you want to end your membership at this date or cancel your membership in your SSi learner account, we will automatically charge the then-applicable periodic membership fee using your preferred payment method.
If your preferred payment method becomes invalid during your membership period, or if the charge is refused for any other reason outside our control, you must provide us a new eligible payment method within 30 days or your membership will be cancelled.
If your SSi membership has been paid by someone else, such as your employer, and you are not billed directly by us, the payment terms provided by that other person or organisation will apply to your membership.
2.3. Cancellation by you and refunds
If you signed up for your SSi membership directly through us, you may cancel it any time by visiting you account page and adjusting your membership settings. You may also contact SSi learner support via admin@saysomethingin.com.
If your SSi membership has been paid by someone else, such as your employer, and you are not billed directly by us, no refund will be applicable to you as an individual.
2.4 SSi first month Confident Speaker guarantee
If you signed up for the £10 per month subscription package, have followed our programme as recommended, and have completed all the set tasks and practices sent to you within the first month, and are not by the end of that time feeling confident in your ability to become a speaker of your chosen language in due course, we will refund your membership fee for that first month, cancel your membership without penalty and also give you the equivalent again of your first month’s fee as a goodwill payment.
To qualify for this offer, you must have held an active ‘basic package’ SSi membership for one month continuously and be able to demonstrate that you have followed the programme as recommended, for example by checking off the tasks and challenges via your account page. To claim your refund under this guarantee, you must request this from our Learner Support Team by sending an email to admin@saysomethingin.com within 30 days of making your second monthly fee payment and before your third monthly fee payment falls due.
We reserve the right to refuse refunds requested after this 30 day period.
This first month refund is only valid for subscribers to our ‘basic’ £10 per month subscription package who are directly paying their own membership. It is not applicable to any other subscription package we offer. This first month refund offer also does not apply if your SSi membership has been paid by someone else, such as your employer, and you are not billed directly by us.
2.5. Promotions and trial memberships
From time to time, we may offer certain customers specific trial or other promotional memberships, which are subject to these Terms except as otherwise stated in the promotional membership terms. Trial and promotional members may at any time choose not to convert or continue to paid or non-promotional membership as set out in these Terms and in the promotional membership terms offered at that time.
2.6. Acceptance of membership
We reserve the right to accept or refuse your membership, to the extent permitted by applicable law.
2.7. No transfer or assignment of membership or benefits
You may not transfer or assign your SSi membership or any benefits including promotion codes for SSi memberships or benefits, except as expressly allowed in these Terms.
2.8. No resale, rental or shipping to customers
SSi members are not permitted to purchase products for the purpose of resale, rental, or to ship to their customers or potential customers using SSi benefits.
2.9. No minors
The SSi Service is only available to end consumers aged 18 years or older.
3. Termination
We may terminate your SSi membership with 14 days’ notice for convenience and will issue a prorated refund of your paid SSi membership fee based on the time remaining in your current membership period.
We may terminate your SSi membership immediately by notice if we consider that (a) your use of the SSi Service materially breaches these Terms or any applicable law or (b) you fraudulently use or misuse the SSi Service. In this case we will not give any refund. We will inform you of the termination of your SSi membership and your right to appeal.
You may terminate your SSi membership at any time in accordance with Clause 2.3.
4. Agreement Changes
We may change these Terms or the SSi Service, or any part of it, at any time: for legal or regulatory reasons; for security reasons; to enhance existing features or add additional features to the SSi Service; to reflect advancements in technology; to make reasonable technical adjustments to the SSi Service; and to ensure the ongoing operability of the SSi Service.
If we make changes, we will inform you in due form and time about it via the email address you provided when you took out your SSi membership and remind you of your rights. You will be able not to accept these changes and you will keep the possibility to cancel your SSi membership at any time.
Regardless of any changes to these Terms or the SSi Service, any increase in the applicable membership fee will not apply before the end of your current membership period.
If any change is found invalid or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions
5. Our Liability
We are liable for any damage you suffer as a result of gross negligence or wilful misconduct by us, including by our directors and legal representatives.
In addition, we are liable for breach of our obligations under these Terms which are essential for the provision of SSi and which you rely on when joining SSi. In this case, we are only liable for losses and damage that were foreseeable to both you and us when you joined SSi.
Nothing in this paragraph affects your statutory rights as a consumer or limits our liability for damages from injury to life, body or health, for a breach of a guarantee or for fraudulently concealed defects.
6. Events Beyond our Reasonable Control
We will not be held responsible for any delay or failure to comply with our obligations under these Terms if the delay or failure arises from any cause which is non foreseeable and beyond our reasonable control.

These conditions are governed by and construed in accordance with the laws of the UK (England and Wales). If you would like to bring a matter to our attention, please contact us via admin@saysomethingin.com.

Gold membership package

These SSi Terms & Conditions (collectively, these "Terms"), are between you and SaySomethingin.com Cyf and they govern your and our respective rights and obligations. They constitute the agreement between you and us related to your SSi Gold membership.
This document should be read in conjunction with our general terms and conditions document set out above. The provisions of our general terms and conditions also apply to our Gold membership package. The terms and conditions set out below are in addition to our general terms and conditions of SSi membership and describe what will be provided under each element of our Gold membership package.
1. Intensive Sprint DaysSSi undertakes to offer at least one intensive Sprint Day per month, which will be available free of charge to all Gold subscribers and any subscribers to the ‘One in a Million’ SSi package. This will be offered at a date of SSi’s choosing. SSi will supply the tutor(s) for each day and the appropriate hosting platform. It will be the responsibility of the subscriber to ensure they have suitable software to access the hosting platform being used.
The maximum number of participants in each day will be 10 people. Additional day(s) will be arranged if numbers exceed that maximum. Participants will be expected to indicate in advance whether or not they will be attending a particular day. SSi is under no obligation to rearrange an offered date if a subscriber is unable to attend.
2. Priority support via emailYou will be provided with a contact email address to use if you require support with your course or subscription. SSi undertakes to respond to you within a 24 hour period after receiving contact from you.
SSi reserves the right to withdraw this service if a subscriber is deemed to be abusive to staff or otherwise misusing this facility.
3. Private support channel with our accelerated learning specialistsYou will be provided with access to an exclusive subscriber Slack channel where you can make contact with other Gold and ‘One in a Million’ subscribers and our tutors, who are trained accelerated learning specialists.
SSi reserves the right to withdraw this service if a subscriber is deemed to be abusive to staff, other subscribers, or otherwise misusing this facility.
4. Exclusive online eventsSSi undertakes to offer at least one exclusive online event per 3 month period, which will be available free of charge to all Gold subscribers and any subscribers to the ‘One in a Million’ SSi package. This will be offered at a date of SSi’s choosing. SSi will decide the type and format of the event, and supply the appropriate hosting platform. It will be the responsibility of the subscriber to ensure they have suitable software to access the hosting platform being used.
Examples of the types of events which will be arranged include but are not restricted to online gigs, poetry readings, discussions with authors and talks from leaders in their professional field. Participants will be expected to indicate in advance whether or not they will be attending a particular event. SSi is under no obligation to rearrange an offered date if a subscriber is unable to attend.
5. Special member discountsYou will be given access to a section of the SSi website which provides details of member discounts available to Gold and One in a Million subscribers with Welsh businesses. Any queries about a discount scheme should be raised with the relevant discount provider. SSi cannot intervene in any dispute between a subscriber and a discount provider.
SSi reserves the right to withdraw discounts and to change the list of discount providers at any time.
6. Free SSi T-shirt & member card/badgeOn taking out a Gold subscription, you will be asked to provide details of your address and clothing size. SSi will then despatch you a T-shirt and member card and member badge free of charge within a month of you providing us with that information. Only one T-shirt, membership card and badge will be provided per subscriber. SSi reserves the right to charge for any replacement or additional items required.
7. One GIFT silver membership for a friendOn taking out a Gold subscription, you will be asked to provide details of a person to whom you would like to offer a free SSi Silver subscription worth £10 per month. This person will then receive access to our courses as applicable with that subscription package, provided that you continue to hold an active Gold subscription. If you cancel your Gold subscription, the associated Silver subscription will also end. SSi reserves the right to cancel the Silver subscription of your nominee if we discover that they are not adhering to the terms and conditions of that subscription. In that event, you would be invited to nominate a replacement, to whom the same conditions of subscription would apply.
One in a Million membership package

This document should be read in conjunction with our general terms and conditions document set out above. The provisions of our general terms and conditions also apply to our One in a Million membership package. The terms and conditions set out below are in addition to our general terms and conditions of SSi membership and describe what will be provided under each element of our One in a Million membership package.
1. This person will then receive access to our courses as applicable with that subscription package, provided that you continue to hold an active One in a Million subscription. If you cancel your One in a Million subscription, the associated Gold subscription will also end. SSi reserves the right to cancel the Gold subscription of your nominee if we discover that they are not adhering to the terms and conditions of that subscription. In that event, you would be invited to nominate a replacement, to whom the same conditions of subscription would apply.
8. One 30 minute 1-on-1 video call each monthSSi undertakes to provide one individual video call per month with you. We will offer a range of options between 9.00am and 5.00pm Monday to Friday from which you can choose which suits you best. SSi will supply the tutor(s) for each video call and the appropriate hosting platform. It will be your responsibility to ensure you have suitable software to access the hosting platform being used.
9. Unlimited access to all new SSi language coursesYou will be given access to all existing and new language courses launched by SSi. Your access to these courses will be conditional on you continuing to hold an active One in a Million subscription. If you cancel your subscription at any time, you will no longer be able to access SSi courses.
10 Exclusive lunch/dinner invitationsSSi will organise lunch and dinner events exclusively for One in a Million subscribers at locations and venues of SSi’s choice. Where possible, these will be held at least twice in a 12 month period. Reasonable costs of food and drink will be covered by SSi. SSi is not able to cover any other costs relating to these events including but not restricted to travel or accommodation.
11. A FREE one year subscription anniversary celebration weekend, (accommodation and food included) at the magical Nant Gwrtheyrn.Once you have made 12 monthly payments of your One in a Million subscription fee, SSi will cover the cost of a weekend’s stay at Nant Gwrtheyrn, in North Wales. This will comprise accommodation and food costs for a Friday evening to Monday morning stay on site and meals taken in the Nant Gwrtheyrn restaurant. SSi will also provide one bottle of wine or non-alcoholic drink to enable you to celebrate your subscription anniversary.
SSi is not able to cover any other costs relating to this stay including but not restricted to travel or accommodation. This stay also does not include any accompanying tuition, although this can be booked direct with Nant Gwrtheyrn if desired. You will be responsible for liaising with the Nant Gwrtheyrn booking team to confirm the dates of your stay. Neither SSi nor the Nant Gwrtheyrn team can guarantee that specific dates requested will be available. SSi cannot intervene in any dispute between a subscriber and Nant Gwrtheyrn about your stay.
